1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fork Development ("we," "us," or "our"), governing your access to and use of Polar Client software, website (shop.polarclient.lol), and all related services (collectively, the "Service").

By purchasing, downloading, installing, or using Polar Client, you acknowledge that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM PURCHASING OR USING THE SERVICE.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of the Service following any changes constitutes acceptance of the modified Terms.

2. LICENSE GRANT AND RESTRICTIONS

2.1 License Grant

Upon purchase and subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Polar Client.

2.2 License Types

  • Standard License (Polar): Permits one (1) concurrent instance

  • Premium License (Polar+): Includes premium features with one (1) concurrent instance

  • Additional Instances: May be purchased separately to increase concurrent usage

2.3 "Lifetime" License Conditions

Any "lifetime" license is explicitly contingent upon your continued compliance with these Terms or for the operational lifetime of the service. Violation of these Terms will result in immediate and permanent revocation without refund.

2.4 License Restrictions

You SHALL NOT:

  • Share, sell, rent, lease, sublicense, or transfer your license to any third party

  • Use the Service on more concurrent instances than your license permits

  • Modify, merge, or create derivative works based on the Service

  • Circumvent any authentication or security measures

  • Use the Service with unauthorized modifications or third-party clients

3. INTELLECTUAL PROPERTY RIGHTS

All source code, algorithms, methods, techniques, processes, designs, graphics, software architecture, and other materials comprising Polar Client are the exclusive property of Fork Development and are protected by copyright, trade secret, and other intellectual property laws.

You acknowledge that no title to the intellectual property in the Service is transferred to you. You are granted only the limited use rights explicitly specified in these Terms.

4. STRICTLY PROHIBITED ACTIVITIES

THE FOLLOWING ACTIVITIES ARE STRICTLY FORBIDDEN AND WILL RESULT IN IMMEDIATE LICENSE TERMINATION:

4.1 Reverse Engineering

You SHALL NOT decompile, reverse engineer, disassemble, decrypt, extract, or otherwise attempt to derive the source code, underlying algorithms, or structure of Polar Client or any component thereof. This includes but is not limited to:

  • Static or dynamic analysis of the software

  • Memory inspection or manipulation

  • Network traffic analysis for circumvention purposes

  • Creation of documentation describing internal operations

  • Sharing technical details about the software's implementation

4.2 Griefing and Harassment

You SHALL NOT use Polar Client to:

  • Interfere with, disrupt, or negatively impact other users' gameplay experience

  • Engage in griefing, trolling, or harassment of other players

  • Exploit bugs or vulnerabilities to harm other users

  • Coordinate attacks against other players or servers

4.3 Additional Prohibited Activities

  • Creating or using unauthorized copies of the software

  • Bypassing, removing, or defeating any copy protection or authentication

  • Using the Service to violate Mojang/Microsoft's EULA or Terms

  • Facilitating or enabling others to violate these Terms

  • Using automated tools to interact with our services

  • Attempting to discover other users of Polar Client

  • Distributing, leaking, or sharing the software files

  • Using the Service on cracked Minecraft accounts

  • Operating the Service through VPNs or proxies to evade bans

  • Impersonating Fork Development staff or representatives

  • Using the Service to develop competing products

5. USER ACCOUNTS AND REGISTRATION

5.1 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. You are responsible for safeguarding your account credentials.

5.2 Account Security

You are solely responsible for any activity occurring under your account. You must immediately notify us of any unauthorized use or security breach. We will not be liable for any losses arising from unauthorized account use.

5.3 Age Requirements

By using the Service, you represent that you have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent to use the Service.

6. AUTHENTICATION AND ANTI-PIRACY

6.1 Authentication Requirements

The Service requires periodic authentication to verify license validity. You consent to:

  • Automatic authentication checks

  • Hardware fingerprinting for license verification

  • Collection of system information for anti-piracy purposes

6.2 Anti-Piracy Measures

We employ various technical measures to prevent unauthorized use. Attempting to circumvent these measures violates these Terms and may violate applicable laws.

7. DATA COLLECTION AND PRIVACY

7.1 Information We Collect

By using the Service, you consent to our collection of:

  • Minecraft UUID and username

  • IP addresses and network information

  • Hardware identifiers and system specifications

  • Discord account information (username, ID, OAuth tokens for server integration)

  • Usage statistics and performance metrics

  • Any information you provide through the Service

7.2 Use of Information

Collected data is used for:

  • License authentication and management

  • Anti-piracy and fraud prevention

  • Service improvement and development

  • Customer support

  • Legal compliance

7.3 Data Sharing

We will not share your personal data with third parties except:

  • As required by law or legal process

  • To protect our rights or property

  • To investigate violations of these Terms

  • With your explicit consent

8. REFUND POLICY

8.1 European Union Residents

In accordance with EU consumer protection laws, EU residents have the right to withdraw from their purchase within fourteen (14) days of purchase without giving any reason, provided that:

  • The software has not been downloaded or activated

  • You explicitly acknowledge losing the right of withdrawal upon download/activation

8.2 Other Jurisdictions

For non-EU residents, all sales are final unless otherwise required by local law or at our sole discretion.

8.3 Refund Exclusions

No refunds will be provided for:

  • Licenses terminated due to Terms violations

  • Purchases made more than 14 days prior (EU) or immediately (non-EU)

  • Licenses that have been actively used

9. PAYMENT TERMS

9.1 Payment Processing

Payments are processed through third-party providers including Shopify, PayPal, and cryptocurrency processors. You agree to their respective terms of service.

9.2 Pricing

All prices are subject to change without notice. Price changes will not affect existing licenses.

9.3 Chargebacks

Initiating a chargeback without first attempting resolution through our support channels will result in immediate license termination and may result in legal action.

10. SERVICE AVAILABILITY AND MODIFICATIONS

10.1 Service Availability

While we aim for 100% uptime, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance

  • Updates and improvements

  • Technical difficulties

10.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.

11. TERMINATION

11.1 Termination by Us

We may terminate your license immediately without notice if you violate these Terms. Upon termination:

  • Your license becomes permanently invalid

  • You must cease all use of the Service

  • You must delete all copies of the software

  • No refund will be provided

11.2 Ban Evasion

Creating new accounts or using alternative methods to circumvent a termination is prohibited and may result in legal action.

12. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM:

  • Warranties of merchantability or fitness for a particular purpose

  • That the Service will be error-free or uninterrupted

  • That the Service will be compatible with all Minecraft versions or servers

  • That the Service will remain undetected by anti-cheat systems

  • Any responsibility for account penalties imposed by Mojang/Microsoft or server operators

YOU USE THE SERVICE AT YOUR OWN RISK. We are not responsible for any penalties, bans, or other consequences resulting from your use of the Service.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the amount you paid for your license

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages

  • We are not responsible for loss of game progress, items, or accounts

  • We are not liable for actions taken by third parties including game developers or server operators

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Fork Development and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your use of the Service

  • Your violation of any third-party rights or terms

  • Any content you submit through the Service

15. GOVERNING LAW AND DISPUTES

15.1 Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes shall be resolved through binding arbitration in the United Kingdom where legally permitted. EU consumers may bring proceedings in their country of residence.

15.3 Informal Resolution

Before initiating formal proceedings, you agree to attempt informal resolution by contacting [email protected] for at least thirty (30) days.

16. THIRD-PARTY SERVICES

16.1 Minecraft/Mojang

Use of Polar Client requires a legitimate Minecraft account. You must comply with all Mojang/Microsoft terms and conditions.

16.2 Discord Integration

Optional Discord integration is subject to Discord's Terms of Service and Privacy Policy.

16.3 No Endorsement

References to third-party services do not constitute endorsement. We are not affiliated with Mojang, Microsoft, or Discord.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms constitute the entire agreement between you and Fork Development regarding the Service.

17.2 Severability

If any provision is found unenforceable, the remaining provisions shall continue in full force.

17.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver.

17.4 Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.
